UAE Trademark Registration
Registration of Trade Mark in UAE covers all seven
Emirates of the
UAE (Abu-Dhabi, Dubai, Sharjah, Ajman, Al Fujirah,
Ras Al Khaimah
and Umm Al Quwain).
Registration
is based on Federal Law No.8 for the year 2002
amending Articles of the Federal Law No.37 for the year 1992
Concerning Trade
Marks.
Separate
application is required for each trade mark in each
class of
the international classification (Nice
Classification 8th edition). UAE is a member of the Paris Convention.
§
Trademarks
are examined as to novelty and after acceptance it
is
published in two daily newspapers in addition
to the Official Gazette.
Term of opposition is 30 days from the date of
publication in the Official
Gazette.
§
Registration
of marks remains valid for a term of 10 years which
can be renewed within the last year of the original
term.
§
Grace
period of 3 months is allowed for renewal on payment
of extra
fine.
§
Renewal is published in two daily newspapers in
addition to the Official
Gazette.
§
Assignment, Licence , Mortgage of trade mark shall
not be considered
valid against any third party unless it is recorded
with the Trade Mark
Office.
§ It should be noted
that any amendment entered on the record of the
registered mark ( eg
assignment, change of name , licence, change of
address, etc.) should be
published in two daily newspapers and the
Official Gazette.
